Terms of Use
Draft for review. Before publishing, fill in the bracketed details and have this checked by a lawyer, in particular the Australian Consumer Law and liability sections.
The short version
- You must be 18 or over, have one account, and be honest about who you are.
- Be respectful. Harassment, hate, scams, explicit content and pressuring people get you banned.
- Meet in public and look after yourself. We verify that people match their photos, but we don't do background checks.
- Sixish is free right now. If we ever add paid features, we'll tell you first.
1. About these terms
These terms are an agreement between you and Erik Sawaya (ABN 93 459 952 619) ("Sixish", "we", "us"). By creating an account or using the Sixish app, you agree to them and to our Privacy Policy. If you don't agree, please don't use Sixish.
2. Who can use Sixish
To use Sixish you must:
- be at least 18 years old;
- be able to form a binding agreement, and not be prohibited from using Sixish by law or by a previous ban;
- not have been convicted of, or be subject to any court order relating to, a sexual offence, violent offence or family violence offence;
- have only one account, in your own name, using a mobile number you control;
- be in an area where Sixish is available (currently Melbourne, Australia).
3. Your account
- You sign in with a one-time code sent to your mobile number. Keep your phone secure, because anyone with it may be able to access your account.
- The information in your profile must be accurate and current, and your photos must be recent photos of you.
- You can pause or delete your account at any time in the app.
4. How Sixish works
- Each day at about 6pm (Melbourne time) we may introduce you to a small number of people. How many intros you get, and whether you get any on a given day, depends on who's available. We don't guarantee any number of introductions, matches or dates.
- If you're both interested, you have 48 hours to plan a date. After that the match closes.
- Before a first date is confirmed, both people complete a selfie check.
- We may change, add or remove features as Sixish grows.
5. Community guidelines
Sixish only works if everyone treats each other well. You must not:
- harass, bully, stalk, threaten or intimidate anyone, or keep contacting someone who has made clear they're not interested;
- post or send hateful, discriminatory or violent content, including about someone's race, ethnicity, religion, disability, gender, sexual orientation or gender identity;
- post or send nudity or sexually explicit content, or send any sexual content that the other person hasn't clearly asked for;
- pretend to be someone else, use someone else's photos, or misrepresent your age, relationship status or intentions;
- ask for or offer money, gifts, investments or financial help, or promote any business, product, service or other app;
- offer or request sex work or any illegal activity;
- share anyone else's private information (including screenshots of their profile or messages) without their consent;
- use Sixish if you're under 18, or involve anyone under 18 in any way;
- use bots, scrape data, or interfere with or try to get around how Sixish works, including our safety features.
6. Your safety
- Sixish does not run criminal background checks or verify identity documents. Selfie verification only confirms that someone is a real person who looks like their photos.
- You're responsible for your own interactions with other members, online and in person. Please follow the tips in the app's Safety centre: meet in public, tell a friend your plans (you can share them from the date card), arrange your own transport, and leave whenever you want.
- If you ever feel unsafe, leave and call 000 in an emergency. Report anyone who breaks these rules. Reports are confidential.
7. Your content
- You keep ownership of the photos, prompts, messages and other content you add ("your content").
- You give us a non-exclusive, royalty-free licence to host, store, reproduce and display your content, and to adapt its format (for example resizing photos), only as needed to run, improve and protect Sixish. This licence ends when your content or account is deleted, except for copies we keep as described in our Privacy Policy.
- You're responsible for your content and must have the right to share it.
8. Moderation, suspension and bans
- We use automated checks and human review. We may remove content, limit features, suspend or permanently ban an account, and block a phone number from signing up again, if we reasonably believe someone has broken these terms, put others at risk, or broken the law.
- When we take action against an account, we may end its matches and cancel any planned dates.
- If you think we got it wrong, email hey@sixish.love and we'll take another look.
9. Price
Sixish is currently free. If we introduce paid features in the future, we'll tell you in advance, and you'll never be charged without agreeing to it first.
10. Australian Consumer Law and our liability
- Nothing in these terms excludes, restricts or modifies any consumer guarantee, right or remedy you have under the Australian Consumer Law or any other law that can't be excluded.
- To the extent the law allows, Sixish is provided "as is". We don't promise it will always be available or error-free, or that you'll meet anyone in particular.
- To the extent the law allows, we're not liable for the conduct of other members, on or off Sixish, or for any indirect or consequential loss. Where our liability for failing to meet a consumer guarantee can be limited, it's limited to supplying the service again or paying the cost of having it supplied again.
11. Ending this agreement
You can stop using Sixish and delete your account at any time. We can end this agreement or stop offering Sixish by giving you reasonable notice, or straight away if you've seriously broken these terms. Sections 7, 10 and 13 continue to apply after the agreement ends.
12. Changes to these terms
We may update these terms as Sixish changes. If a change is significant, we'll tell you in the app before it takes effect. If you keep using Sixish after that, you accept the updated terms. If you don't agree, you can delete your account.
13. General
- These terms are governed by the laws of Victoria, Australia, and you and we submit to the courts of Victoria.
- If part of these terms can't be enforced, the rest still applies.
- Apple is not a party to these terms and isn't responsible for Sixish or its content. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them.
